Settlement in Commerce Township Dog Bite Attack
A Commerce Township dog bite attack settlement was recently won by our attorneys at the law firm of Buckfire & Buckfire, P.C. on behalf of a woman who was bitten while walking within her condominium complex. Due to the vicious canine attack, the 65-year-old victim suffered serious injuries including multiple puncture wounds on her leg, permanent scarring, and psychological injuries. The resulting injuries were so severe she was transported to Providence Park Hospital immediately after the incident by EMS.
Quite often, a person suffers dog bite injuries from an attack by a neighbors dog. Under Michigan law, the person who owns, keeps, or harbors the dog is responsible for the attack, regardless of prior knowledge (called, “strict liability” laws) of the viciousness of the animal. Also, the negligence law is used to hold the owner responsible for the attack. This means that the dog owner is liable if the bite injury occurred because the dog owner was unreasonably careless in controlling the animal.
Our client lives in the condo complex in which she was attacked. The canine was a 70-pound white mix breed dog. The dog was loose at the time of the attack, and launched at our client, biting her several times on the back of her leg (calf area).
The lawsuit was filed in the Oakland County Circuit Court and we were able to attain a settlement for our client before going to trial in the amount of $42,000. The settlement was paid by the dog owner’ insurance company. In addition to the settlement, we were also able to receive reimbursement of our client’s medical bills due to her injuries in the amount of $885.00. The insurance company responsible for reimbursement was Blue Cross Blue Shield.
