$45,000 MI Dog Attack Settlement For Post-Traumatic Stress

Our Michigan lawyers recently settled a dog bite claim for a 68 year old Interlochen woman who was viciously attacked by two of her neighbor’s dogs on her own property.  The incident occurred as she was walking her own small dog just off of her property.  Her own dog was also attacked and had injuries requiring veterinary care.

The dog attack occurred when the two dogs ran without restraints the public street near our client’s home.  The dogs chased our client and her dog onto her own property and into her garage.  They jumped onto them and began to bite.  Our client was bitten as she tried to protect her own dog and then as she tried to enter into her home.  She suffered multiple bites to her arms and legs and required admission to a local hospital.

In Michigan, the law holds the person who owns, keeps, or harbors the dog responsible for a dog bite or attack, regardless of prior knowledge (called, “strict liability” laws) of the viciousness of the animal. This is called the dog-bite statute and clearly states that an owner is liable and can be sued for the injuries in the attack, seeing that the victim was lawfully on property or public property.

Our client suffered some puncture wound scars and scratches on her arms and hands.  She was hospitalized at a local hospital for her dog bite injuries.  Due to the psychological trauma of the attack, she suffered post-traumatic stress syndrome (PTSD) and received counseling from a psychologist.  We filed a dog bite injury claim on her behalf against the dog owners for her pain and suffering, psychological damages, and medical expenses.  The homeowner’s insurance company for the owner of the dogs agreed to pay her a $45,000.00 settlement.  The case was settled before a lawsuit was filed.
