$290,000 Settlement For Roseville, MI Dog Bite

We recently won a $ 290,000.00 settlement for a Detroit man in a Macomb County, Michigan lawsuit.  Our client was in a parking lot in Roseville when an acquaintance pulled his pickup truck into the parking lot.  He called our client over to his car and rolled down the window.

When our client walked over to the car window, a dog in the front seat viciously bit him in the face.  The man fled in but was later tracked down by the police.  Our client suffered significant lacerations to his face which required emergency plastic surgery at a local hospital.  He has permanent scars on his check and above his lip despite the surgery and close follow up care with a physician.

We filed a lawsuit in the Macomb County Circuit Court in Mt. Clemens, Michigan.  Numerous depositions were taken of the parties and other eyewitnesses.  The dog owner had homeowner’s insurance coverage with policy limits of $ 300,000.00.   After lengthy settlement discussions, the insurance company agreed to pay our client $290,000.00 to settle the case before a jury trial.

Can a veterinary assistant sue for a dog bite at work?

Yes, a veterinary assistant can sue the owner of a dog who bites in Michigan.  The law most likely holds true in other states.  Although some attorneys may believe this is only a worker’s compensation claim, our dog bite lawyers recently settled a lawsuit for $150,000.00 for a vet assistant who was bitten on the face by a patient of the practice.  The dog bite her as he was put on the table to start the exam.

Dog owners are strictly liable when their dog bites someone without provocation.  There are very few exceptions to this rule.  Typically, only a trespasser on private property cannot sue of attacked or bitten by a dog.

Metamora Man Mauled to Death in Vicious Dog Attack

On July 23rd, a Metamora Township man was mauled to death by two large dogs who escaped from their owner’s home. Craig Sytsma, 46, of Livonia, was jogging near his work around 5:30 p.m. when he was blindsided by two cane corsos, a breed of dog that averages around 100 pounds.  Our thoughts and sympathies go out to his family.

According to police reports, this is the third incident involving the same dogs since 2012. Under Michigan law, involuntary manslaughter charges may be brought against the owner of the dog.  The Michigan Statute for criminal charges related to dog attacks is 287.321.:

(a) “Dangerous animal” means a dog or other animal that bites or attacks a person, or a dog that bites or attacks and causes serious injury or death to another dog while the other dog is on the property or under the control of its owner.

Bob Lantzy,  the dog bite lawyer at our firm, was contacted by the Detroit News for comment.   The newspaper reported the tragedy last week.    The family should also consider filing a Michigan Wrongful Death lawsuit.   A full investigation of the civil claim should include obtaining all prior dog bite complaints and all prior criminal and civil charges filed against the dog owners.  Based upon news reports, it is terrible that the dogs were not previously removed by animal control.

Bitten By Dog At Friend’s House

Our Michigan dog bite injury lawyers handle cases involving dog bites and attacks throughout the state of Michigan for personal injury damages. Dog bite attacks can be a very traumatic and frightening experience for anyone to have to go through. The injuries sustained from a dog bite can be considerable. They may include broken bones, scarring, deformities, serious lacerations, permanent nerve damage, and even death. Many may also suffer psychological and emotional distress, well after the dog bite attack incident occurred. Victims bitten by a dog do have the right to file a claim in Michigan against the owner of the aggressive dog.bitten by a dog in Michigan

Quite often, the dog bite occurs at the home of a friend or neighbor. This often happens when the families get together for a social visit or holiday gathering. The dog may or may not have had a previous history of biting a visitor.  Making a claim against your friend for a dog bite attack can obviously put a strain on friendship or relationship, but your friend should understand that you are not seeking their personal assets and intend to make an insurance claim.

In these cases, the dog owner’s homeowner’s insurance company usually pays a settlement to the dog bite victim.  The dog bite victim does not have to worry about the friend paying a settlement out of their own pockets and insurance rates usually do not increase after this type of settlement payment.  Therefore, if both friends act in a civil manner after the attack they can still maintain their relationship after the victim is fairly compensated for the dog bite injuries.

If you or a family member is bitten by a dog at a friend’s house, you should contact our Michigan dog bite injury lawyers as soon as possible after the attack so that we can explain your legal rights to you and begin our investigation of the claim.  We will represent you under our No Fee Promise, which means we do not charge any legal fees or costs until we win your settlement.

Often times, a dog attack does occur at the property of a neighbor, friend, or acquaintance. Nonetheless, if the person is bitten while lawfully on the property, the owner or keeper of the dog can be held liable for the injuries under Michigan law. In fact, there are several dog bite laws in Michigan that can be used in favor of the victim and hold the dog owner liable. The main statute, called the Michigan dog bite statute, clearly states that an owner of the dog is liable and can be sued for a victims injuries.

If you or a family member is bitten or attacked by dog that was unrestrained, you should contact our Michigan dog bite lawyers as soon as possible at (800) 606-1717 after the attack so that we can explain your legal rights to you and begin our investigation of the claim.
