How To Bring A Michigan Dog Bite Lawsuit

Want to bring a Michigan dog bite lawsuit?  Here is what you need to know to get started on your case.

First, it is essential that you choose the best dog bite lawyer for your case.  Our award winning attorneys have won the highest settlements in Michigan in dog attack cases.   We use our skill, experience, and knowledge to prove liability against the dog owner to maximize the amount of your settlement.  We will do the same for you.

There are several important things that our lawyers do before we ever file a dog bite lawsuit. First, we fully investigate the case and gather all evidence, including witness statements and photographs of the dog bite injuries. We often hire  investigators to document the incident and have a professional photographer take photographs of the scars to best show the severity of the injury.

We also get all of your medical records, medical bills, and expenses related to your care and treatment.  If you suffered lost wages due to the attack, we get documentation to prove the amount of your loss.   This information can be very valuable and can assist in obtaining the best possible settlement for your Michigan dog bite lawsuit.

Process To Bring A Michigan Dog Bite Lawsuit

We start by filing a Michigan Dog Bite Complaint and Jury Demand with the court, unless the insurance company settles the claim sooner. Typical damages a dog bite victim can receive compensation for include:

  • Scars & Disfigurement: If the bite causes scarring or other unsightly marks, your are entitled to recovery for disfigurement.
  • Pain and suffering: This is the right to compensation for physical pain and suffering and mental anguish you have suffered and could possibly endure in the future.
  • Loss of Earnings: You are entitled to recover for the loss of earning which you suffered from your injuries. This includes wages, commissions, bonuses, and all other earnings and fringe benefits.
  • Medical Expenses: Medical expenses that you had to pay for at hospital, clinic, or to a pharmacy.

After the Dog Bite Lawsuit Is Filed

Once the lawsuit is filed, a claim for damages and losses is made and proof of the dog bite attack injury is documents through medical records, medical bills, photographs, and any witness statements that were at the scene of the attack. Many dog bite attack lawsuits are settled out of court because there are very few legitimate defenses to a dog bite case.

However, if both parties cannot agree on a settlement amount, the judge will set a trial date. Although we settle more than 95% of our lawsuits before going to trial, we have a tremendous track record of success in jury trials.   The jury will then determine how seriously you were injured, and the appropriate amount of compensation for your injuries.

We achieve these results by carefully evaluating all aspects of your case, which includes the animal control report, witness statements, medical records, and photographs.  Unlike other law firms, we do not “discount” our cases to the insurance company just make a quick fee.   Our lawyers spend significant time and effort on every case to maximize the best possible settlement for our client.

Roseville Dog Bite Lawyer Files Macomb County Lawsuit

Our dog bite lawyers recently filed a lawsuit in the Macomb County Circuit Court on behalf of a client who suffered serious injuries to his face.  He  was attacked by the defendants pit-bull while standing at a bus stop in Roseville.

Our client had previously worked with the defendant. The defendant had driven into a McDonald’s next to the bus stop and parked his van.   As the defendant climbed out of his van,  his pit-bull jumped out the van just behind him. For no reason at all, the pit-bull bit our client in the face. The bite resulted in a severe laceration of our clients face and lip. The attack has resulted in permanent scarring to our clients face.

The defendant left the scene to get his dog, who ran away, and never returned. The Roseville and Warren animal control officers were able to track down defendant with the assistance of the Roseville Police Department.  A report and investigation substantiated how the attack occurred.  Our client did nothing to provoke this terrible attack.

The doge bite lawsuit was filed in the Macomb County Circuit Court in Mt. Clemens, Michigan. The defendants homeowners insurance carrier hired an attorney to defend the owner.  The lawsuit seeks compensation for pain and suffering, scars, and medical expenses.  No trial date has been set by the court.

$175,000 Livingston County Dog Bite Settlement

Our Fowlerville dog bite  lawyers recently settled a lawsuit on behalf of woman who was attacked by a friends dog.  She was visiting her friend’s home  and was in the kitchen.  The dog was also in the kitchen.

When our client bent over to look at a meal cooking in the oven., the dog jumped up and bit her in the face. The force of the attack was significant. Our client suffered severe lacerations to her face, including the need for more than 60 stiches within her gum and cheek area.  She has permanent scarring and disfigurement, as well as facial numbness due to damaged nerves.

The attack was unprovoked and our client was lawfully on the defendant’s property at the time of the attack. The incident was investigated by the Livingston County Sheriff Department.

We filed a dog bite lawsuit on her behalf in the Livingston County Circuit Court seeking compensation for the injuries suffered in the dog attack.   After depositions of the witnesses were taken, the parties agree to a private mediation of the case.  The case was settled for the amount of $175,000 for her pain and suffering, disfigurement, and other damages.   The settlement was paid by the homeowner’s insurance company for the owner of the dog.

What To Do After Michigan Dog Bite

Not sure what to do after being bitten by a dog in Michigan?  Our experienced Michigan dog bite lawyers have some advice to you.

First, get prompt medical attention either at a doctor’s office, urgent care clinic, or hospital emergency department.  You can treat the wounds initially at home but proper medical care should be sought to prevent an infection or other serious problem.  It is often necessary to a physician stitch up a laceration or wound to prevent  future scarring.

Second, you should report the attack the police or Animal Control agency in your city or county.  Make sure you tell the Officer everything you know about the dog, including name and address of the dog owner.  Quite often, the dog will be quarantined until the agency believes it is safe for the public.

Third, take photographs of the injuries immediately after the bite and throughout the healing process.  This will be helpful if you decide to file a dog bite claim at a later date.

Fourth, contact our experienced dog bite attorneys to see if you are entitled to a settlement.  Although the dog owner’s insurance company may contact you directly, the adjuster usually will try to pay you a lowball offer to get you to sign away your legal rights.  Don’t make this mistake but it can cost you a lot of money and aggravation.

Average Dog Bite Settlement Amounts in Michigan

There is really no “average dog bite settlement amount”  because there numerous factors that go into determining the size of a settlement.  Settlements can range from $1,500.00 for a minor bite to $1,000,000.00 for the most serious injury or even death.  Factors that determine how much your dog bite settlement will be include:

  • Size and location of any scars, marks, or disfigurements
  • Type of medical treatment or plastic surgery needed
  • Need for future medical treatment or plastic surgery
  • Psychological and emotional damages caused by the dog attack
  • Permanency of any injuries from the dog bite attack
  • Amount of past medical bills and future medical bills
  • Amount of lost wages from time missed from work
  • Amount of the insurance policy limits for the dog owner
  • City or county where the incident occurred

Our dog bite lawyers have the experience to review all of the factors in your case and determine the most likely settlement range.  Although our opinion offer differs from the amount the insurance company wants to pay you, we are very successful in winning settlement amounts in the range that we project.  Simply put, we don’t let the insurance adjuster tell us what your case is worth, we tell them.  Our track record of successful dog bite settlements helps to determine the range of your settlement.
