Dog Bite Lawer Wins Royal Oak Settlement

Our Royal Oak dog bite lawyers recently won a settlement for a 9 year old boy in a dog bite lawsuit.  The nine year old boy suffered a dog bite to his face by a neighbor’s dog.  He was playing at his friend’s house with some other neighborhood kids.  When he went to pet the family’s black Labrador retriever,, the dog bit him in the face.   Witnesses to the attack did not see the boy do anything to provoke the dog.

The dog bite caused a significant facial  laceration and the boy was taken to the emergency department at  William Beaumont Hospital in Royal Oak, Michigan.  A plastic surgeon  cleaned up the wound and put stitches in his face.  Despite the prompt treatment,  the bite has left a significant disfiguring scar just above his lip.   He was seen by another plastic surgeon who recommended a revision surgery  after the boy reaches his teens.  This would minimize the scar but it is expected that an observable scar will exist even after the surgery.

Our attorneys filed the Royal Oak dog bite lawsuit against the dog owner in the Oakland County Circuit Court in Pontiac, Michigan.   The lawsuit sought a settlement for the pain and suffering, scar and disfigurement, medical expenses, and future costs of plastic surgery.   Prior to trial, the homeowner’s insurance company for the dog owner agreed to pay a settlement of $142,500.00 to the child.

Medical Bills After Michigan Dog Bite Attack

Michigan dog bite and attacks often require medical treatment and even surgery.  Common injuries include facial scars, lacerations, puncture wounds and other injuries to the skin that require stitches and medical care.  Dog attacks also cause nerve damage, broken bones, and other serious injuries.  The cost of this medical treatment is significant and many times the dog bite victim does not have insurance to cover this treatment.

When a person bitten by a dog in Michigan incurs medical bills as a result of an attack, a claim can be made against the dog owner for payment of medical expenses.  If  the person attacked has health insurance but is responsible for c0-pays or prescription expenses, a claim can be made for those bills as well,  These are damages and compensation sought in a dog bite claim or lawsuit that are in addition for claims relating to the injuries suffered in from the dog bite.

Many times, the dog owner has home owner’s insurance to pay both the medical bills and a personal injury settlement.  Policies often contain a “med pay” provision which automatically pays a certain dollar amount towards medical bills.  This is usually at least $1,000.00 or more of a benefit.

If you or someone you care about suffered a dog bite injury in Michigan, you should contact our experienced lawyers today to start your claim.  We will get the Animal Control report or police report, your medical records, and start your claim against the owner or keeper of the dog.  We have a great track record of large settlements in Michigan dog bite cases.

Monroe Dog Bite Lawyer Settles Child Dog Attack Lawsuit

Our dog bite lawyers in Monroe, Michigan recently settled a lawsuit for a child bitten by a neighbor’s dog.  The nine year old girl was playing on the trampoline in her neighbor’s yard with their permission when their chocolate Labrador retriever attacked her without any provocation.  The dog bit the girl on her left thigh and caused several puncture wounds and lacerations.

Our client was taken to Mercy Memorial Hospital for treatment. The emergency room physician cut off her pants to get to the wounds.  Swelling and bruising were reported in addition to the laceration and puncture wounds caused by the bite.  The ER doctor further reported “Pain, swelling, bleeding”.  She has permanent scars on her inner thigh.

The present case seeks redress for serious and permanent injuries and disfigurement suffered by Cloie Preston, a 9 year old, from a dog attack involving Defendant’s dog.  The defendants dog attacked and bit Cloie on the left thigh as she played in defendants back yard.

We were contacted by the girl’s parents to pursue a claim for damages against the neighbor.  The neighbor had homeowner’s insurance to cover the claim.  We filed a lawsuit in the Monroe County Circuit Court seeking damages for pain and suffering, fright and shock, and the permanent scar.  A claim was also made for the medical expenses incurred as a result of the bite.   We were able to settle the claim for $50,000.00 prior to trial.  A portion of the girl’s money was placed in a college fund for her to use after she graduates from high school.

Can a veterinary assistant sue for a dog bite at work?

Yes, a veterinary assistant can sue the owner of a dog who bites in Michigan.  The law most likely holds true in other states.  Although some attorneys may believe this is only a worker’s compensation claim, our dog bite lawyers recently settled a lawsuit for $150,000.00 for a vet assistant who was bitten on the face by a patient of the practice.  The dog bite her as he was put on the table to start the exam.

Dog owners are strictly liable when their dog bites someone without provocation.  There are very few exceptions to this rule.  Typically, only a trespasser on private property cannot sue of attacked or bitten by a dog.
