Common injuries from dog bites include lacerations to the face, arms, and legs that required stitches, puncture wounds, broken bones, and nerve damage.  Many times, a person falls during a dog attack or is knocked down by the dog and can suffer serious orthopedic injuries. In addition to the physical injuries, many dog bite victims suffer psychological damages and post-traumatic stress disorder as a direct result of the attack.

The Animal Control Ordinance – Allegan County sets forth the county dog bite laws. Allegan County defines a dangerous animal as “an animal that bites or otherwise causes injury to a person or other animal.” Any animal that commits this act is in violation of an ordinance.  This violation is considered evidence of negligence in a Michigan civil lawsuit for a dog bite or attack. Dog Bite Lawyer Settles Oakland County, Michigan Dog Attack Lawsuit

Our dog bite lawyers recently settled an Oakland County dog bite lawsuit for our forty-four year old client who was bitten and attacked by her neighbor’s dogs.  She was attacked by  a German Shepard and Pit Bull owned by her neighbor entered in her own backyard.  After being knocked down by the dogs, she was viciously bitten on her arms and body.   She suffered serious doge bite wounds that required emergency medical treatment and stitches and have left her with permanent disfiguring scars on both her arm and back.  She also suffered nerve damage to her arm which causes numbness and this may be a permanent condition.

A person bitten by a neighbor’s dog does have legal rights to sue the neighbor for the dog bite injuries. In these cases, the dog owner’s homeowner’s insurance company usually pays a settlement to the dog bite victim. Neighbors do not have to worry about the other neighbor paying a settlement out of their own pockets and insurance rates usually do not increase after this type of settlement payment. Therefore, if both neighbors act in a civil manner after the attack they can still maintain their relationship after the victim is fairly compensated for the dog bite injuries.

We filed the Michigan dog attack lawsuit in the Oakland County Circuit Court in Pontiac, Michigan.  The lawsuit sought compensation for her pain and suffering, disfiguring scars, and both physical and psychological injuries suffered in the attack.  The lawsuit also sought damages for the medical expenses paid for the injuries and treatment.  The incident occurred in April 2012 and we filed the lawsuit shortly after the attack.   The parties attended a mediation and agreed to settle the lawsuit for $175,000 in October 2012, just six months after the dog bite attack.  The settlement was paid by the homeowner’s insurance company for the dog owner. Mauled By a Pit Bull in Michigan | MI Dog Bite Lawyer

Our Michigan dog bite lawyers represent victims of dog bites and animal attacks in cases throughout Michigan. We represent a wide range of clients in these cases, including children, postal workers, and utility workers. Pit bulls are considered one of the most dangerous dog breeds to own. According to the National Canine Research Council, in 2010, 33 fatalities occurred within a human population of more than 308 million and a canine population estimated at over 78 million. Although pit bulls remain a small part of the dog population they contribute to the majority of fatalities and injuries each year.

The Centers for Disease Control and Prevention (CDC) announced that from 2006-2008 pit bulls were found responsible for nearly 60% of deaths in the United States dog bite fatalities. Often times dog bites can result in severe injuries such as disfigurement resulting from scars, injection, broken bones, nerve damage, and even pain and suffering.  Other dangerous dog breeds to look out for include:

• Rottweiler

• German Shepard

• Husky

• Malamute

• Dalmatian

• Pres Canario

• Doberman Pinschers

• Boxer

• Chow Chow

According to other statistics, each day, about 1,000 U.S. citizens require emergency care treatment for a dog bite injury. The majority of those injured are children ranging in age from 5-9 years old. For dog bite preventive purposes, it is important to remember to supervise your younger children playing with the family dog at all times. In addition, to minimize dog aggressiveness the Centers for Disease Control and Prevention (CDC) suggest to neuter, don’t play aggressive games, properly socialize and train your dog, and immediately seek professional advice if your dog develops aggressive behavior.

There are specific Michigan laws that apply to dog bite cases. Owners and keepers of dogs in Michigan are strictly liable for dog bites and attacks. This means that the dog bite victim does not have to prove that the owner was negligent, only that he or she was bitten or attacked by the dog. There are also strict Michigan leash laws that hold the dog owner liable if their unleashed dog bites or attacks an innocent person.

Owners of dogs should know important information about their dog and things that they can do to prevent dog bites and attacks.

Victims and their families can file a lawsuit against the dog owner for the injuries suffered.  A lawsuit for a Michigan dog bite must be filed with the court, unless the insurance company settles the claim sooner.  Once the lawsuit is filed, a claim for damages and losses is made and proof of the dog bite attack injury is documented through medical records, medical bills, photographs, and any witnesses that were at the scene of the attack.  In fact, our Michigan dog bite lawyers recommend victims to take photos and descriptions of the place where the attack occurred to help assist your case and get the best possible dog bite settlement.

Other useful evidence a victim should collect at the time of the attack include the names of the dog and dog owner, the dog owner’s address, addresses and names of people who witnessed the attack, and medical evaluation of the wound by the treating physician. In situations in which a victim dies due to the injuries suffered in the dog attack, the family can file a Michigan wrongful death claim for the loss of their loved one.
